 The ban on ephedra has been temporarily reversed and is now at the 10th Circuit Court of Appeals. In August of 2006 the Circuit Court upheld the orignal decision to ban ephedra. The decision is now to the judge to make the final rulling. There is a good chance that this decision may go to the Supreme Court.
Ephedra was originally banned on the grounds that it has no proven health benefits. It was not banned on that fact that it is harmful. The belief is that the FDA went to far with ephedra. If the FDA wins in banning ephedra based on this rulling there is nothing stopping the FDA from banning Coke since soda has no proven health benefits.
